Under Pennsylvania’s DUI statute, driving under the influence of alcohol is charged as a misdemeanor. Each offense raises the level of penalty assessed. For example, based upon your blood alcohol content a first offense has a mandatory minimum sentence of 72 hours in jail. A second offense with the same blood alcohol content has a mandatory minimum sentence of 90 days in jail. A third offense with the same blood alcohol content has a one year sentence which would be served in a state correctional facility.
There are many ways to approach your defense if you have one or more prior DUIs on your record
Some lawyers seek only to resolve the charge through the adversarial system at a trial, while others only try to negotiate a reduction in charges or sentence. Few have the skill, experience or dedication to do both. At the law firm of Fiore & Barber, LLC, we can start work early in the process to negotiate with district attorneys while simultaneously building the strongest defense available under the law. Contact us today for a free consultation.
While we are working to challenge field sobriety tests, breathalyzer tests and/or blood alcohol testing methods and the other evidence against you, we also discuss your cases with the arresting police officer to see if a negotiated agreement is possible. We can also work with the system to find a workable solution that keeps you out of jail, such as home confinement (also known as house arrest) or a work release program that lets you keep your job.
We have a record of success in helping clients with a prior DUI conviction take advantage of second offenders’ programs, such as, Chester County’s Intermediate Punishment Program or the Berks County STOP program. We have even helped clients with other alternatives to incarceration such as house arrest and probation in these cases.
